Exclusão do refúgio na caravana centro-americana - 2018

Abstract

This article reviews the conventional criteria for denying asylum to certain applicants in order to criticize the exclusion of Central American immigrants from the right to apply for asylum. Through the study of the case of the Caravan of these immigrants, which left Mexico for the US in 2018, the conditions that prompted the displacement, the timing of the crossing and the American reactions regarding the granting or not of prima facie refuge in light of those criteria will be reviewed. We hope to offer a less exclusionary and criminalizing view of these people and their right to seek refuge protection.
